Infrastructure, Confidentiality and Security

ICS Policy

Purpose

After the events of 911 and the creation of the Department of Homeland Security, Congress and the North Carolina General Assembly amended the Freedom of Information-Privacy Acts (FOIPA) and North Carolina General Statutes Chapter 132, Public Records to exclude information about sensitive infrastructure from the general public. The Cabarrus County ICS policy was written in collaboration with WSACC and the City of Concord. This policy will specifically control and protect the water and sewer infrastructure of WSACC and all jurisdictions with which we do business. Cabarrus County has worked closely with WSACC and the jurisdictions within Cabarrus County to produce a policy that can be adopted by all jurisdictions. The City of Concord and Cabarrus County and WSACC have adopted this policy.

Procedures/Rules

No utility infrastructure data in the form of maps, plans, drawing or digital files will be made available to the public without demonstrating a need that complies with the ICS policy. The policy provides access to the data through three tiers of access and an inter-jurisdictional agreement. All access, tiers and agreement require a written form to be completed and logs maintained for tracking of data use.

  • Tier 1 is for licensed professionals that are WSACC or one of the jurisdictions that it serves. Allows for the distribution of a full data set. The Tier 1 registrant must be approved by the data owner. Cabarrus County can not distribute full data sets containing water & sewer without the permission of the data owner (Concord, WSACC, Mt. Pleasant, Kannapolis, etc).

  • Tier 2 is for non-licensed professionals, business firms or associations, in cases where access to this information furthers a public policy or project. Allows for the distribution of a partial "project specific" data set. Tier 2 registrants may be approved at the department level.

  • Tier 3 is for individuals or firms that would like to view detailed plans, drawings or documentation of public infrastructure for the purpose of determining the proximity of the infrastructure to their property or a property of interest. Tier 3 registrants may be approved at the department level.

The inter-jurisdictional agreement covers the free flow of full data sets data between Cabarrus County, WSACC and the jurisdictions.

All hard copy maps documents must have notice.

Sensitive information not to be copied or distributed without the express written consent of Cabarrus County. In compliance with - North Carolina Public Records Law All information provided was created for the County's internal use. Cabarrus County, its agents, and employees are not responsible for and shall not be held liable for any errors in the data, including but not limited to, errors of omission, commission, content and or relative or positional accuracy. Data provided shall not be construed as a legal document. Any resale of this data is strictly prohibited in accordance with North Carolina General Statue 132-10.

Violators of the policy may be precluded from doing business with Cabarrus County for a minimum of 5 years or more, and Cabarrus County may seek recovery of any damages experienced as a result of the violations.
